CHRISTMAS.GLOBAL TERMS AND CONDITIONS (FOR SALES PERSON)

  • Sales person is NOT an employee and the business association relationship is always at will.
  • Sales person must agree that they are a 1099 contractor.
  • Sales person must Obtain a free EIN from IRS.GOV and input a PayPal email on each order that is associated with their own EIN # on this site.
  • Sales person must agree to accept all of their commission payments via PayPal.
  • Sales person must input a valid PayPal email address in order to receive payment of commission
  • Sales person agrees that payment will only be made to the PayPal address associated on this site with their EIN.
  • Sales person agrees to receive an electronic copy of their 1099 tax statement.
  • Sales person must input valid email address to receive a copy of their 1099.
  • Sale person must agree to accept an emailed copy of their 1099.
  • Sales person must also agree to accept text messages.
  • Sales person must agree that venue is the State of Georgia.
  • Sales person agrees that Christmas.global is a separate entity.
  • Sales person must warrant that they have not made any additional representations to vendor other than those statements expressly disclosed on the Christmas.global website.
  • Sales person must warrant that they understand that they will only receive a 10% OR 15% OR 20% commission of each individual sale only IF sales person accurately lists a: PayPal email (associated with their name and EIN information) address appears on the order at the moment the order is placed. If the Sales persons CORRECT PAYPAL email address is omitted from Vendor sign up, there will be no commission paid.
  • Sales commission for 1-50 sales in any of the 12 individual calendar months = 10% commission.
  • Sales commission for 51-100 sales in any of the 12 individual calendar months = 15%.
  • Sales commission for over 100+ sales in any of the 12 individual calendar months = 20%.
  • Sales person accepts responsibility for ensuring that their correct PAYPAL address appears on the order
  • Sales person understands that if for any reason, Vendor requests a refund that a commission will not be paid even if that refund is not granted.
  • Sales person agrees that commission will be paid monthly but one quarter after the date of the sale. Ex. Sales for any day in the month of January will be paid on the last day of April at least 91 days after the day the sale closes.
  • Sales person warrants that they will not solicit advertising from any Vendor whose business violates the laws of the United States and its territories or for products involving endangered species. Ex. No sales to Vendors of Ivory or other banned substances or illegal substances.
  • Sales associate acknowledges commission may be subject to federal or state liens or other legal process. In such case Sales associate agrees that Christmas.global shall be held harmless for any and all financial losses experienced by seller

PAYMENT

  • CURRENTLY MONEY WILL BE PAID IN THE CURRENCY OF THE UNITED STATES OF AMERICA.
  • NOTICE: IF A VENDOR USES A SALES PERSON, VENDOR/SALES PERSON MUST INPUT SALES PERSON’S, PAYPAL EMAIL AT SIGN UP OR NO COMMISSION WILL BE PAID. NO EXCEPTIONS.
  • $360.00 PER 3 YEAR DIRECTORY LISTING TERM = 10% COMMISSION = $36.00 10% COMMISSION IS PAID FOR ALL MONTHLY SALES UP TO 50 SALES PER CALENDAR MONTH.
  • 15% COMMISSION IS PAID FOR ALL MONTHLY SALES IN A SPECIFIC MONTH WHEN SALES EXCEED 50 MEMBERSHIPS IN A CALENDAR MONTH. (FOR ALL SALES UP TO AND INCLUDING 100 CALENDAR MONTHLY SALES) $360.00 PER 3 YEAR DIRECTORY LISTING TERM = $54.00
  • 20% COMMISSION IS PAID FOR ALL MONTHLY SALES OCCURRING IN A SPECIFIC MONTH, WHEN A SELLER ACHIEVES OVER 100 CALENDAR MONTHLY SALES. $360.00 PER 3 YEAR DIRECTORY LISTING TERM = $72.00
  • NOTE: A CALENDAR MONTH IS A LITERAL CALENDAR MONTH OF WHICH THERE ARE 12 DISTINCT MONTHS. (EX. JANUARY HAS 31 DAYS, COMMISSION ON ALL SALES OCCURING IN ANY CALENDAR MONTH WILL BE COUNTED SEPARATELY FROM ANY SALES OCCURRING IN ANY OTHER CALENDAR MONTH)
  • FOR ISSUES ARISING UNDER THIS CONTRACT - CONTACT US VIA CHRISTMAS.GLOBAL WEBSITE.
  • SELLER AGREES THAT THEY ARE RESPONSIBLE FOR KNOWING AND CONTINUE TO AGREE WITH THE POSTED TERMS AND CONDITIONS OF THIS SITE.
  • SELLER AGREES TO INDEMNIFY AND HOLD HARMLESS CHRISTMAS.GLOBAL AGAINST ALL LEGAL PROCEEDINGS INVOLVING SELLERS ACTIVITIES.
  • IN THE EVENT OF A LEGAL DISPUTE BETWEEN THE SELLER AND CHRISTMAS.GLOBAL, THE SELLER AGREES THAT ALL DISPUTES WILL BE GOVERNED BY GEORGIA LAW AND LITIGATED IN A STATE COURT FORUM WITHIN THE COUNTY OF FULTON, STATE OF GEORGIA
  • SELLER AGREES THAT DAMAGES ARE LIMITED TO THE VALUE OF SERVICES SOLD AND THAT SELLER IS RESPONSIBLE FOR HIS/HER OWN ATTORNEYS FEES
  • SALES PERSON WILL ONLY BE PAID VIA PAYPAL AND MUST PROVIDE AN ACTIVE PAYPAL ACCOUNT IN GOOD STANDING.
  • CHRISTMAS.GLOBAL IS NOT RESPONSIBLE FOR ENSURING THAT SALESPERSONS PAYPAL ACCOUNT CAN ACCEPT REMITTANCE.
  • SALES PERSON ACCEPTS THAT IF CHRISTMAS.GLOBAL
  • IS NOT ABLE TO PAY SALEPERSON DUE TO A NON-FUNCTIONING PAYPAL ACCOUNT; AFTER 6 MONTHS OF ATTEMPTS SALESPERSON IS DEEMED TO HAVE FORFEITED AND DONATED HIS COMMISSION TO A CHARITABLE ORGANIZATION SUCH AS THE SALVATION ARMY OR FEED THE HUNGRY IF POSSIBLE, FOR AS LONG AS THEY CONTINUE TO BE REPUTABLE CHARITIES. SELLER WILL BE DEEMED TO HAVE MADE THE DONATION. AND SAID DONATION WILL BE ATTRIBUTED TO SALES PERSON NAME AND EIN. SELLER WARRANTS THAT THEY WILL NOT SEEK ANY RECOURSE TO OBTAIN FUNDS FROM WWW CHRISTMAS.GLOBAL, RELATED TO SAID DONATION.
